Terms of Service.

These terms govern your use of the whistleracuity.com website. The terms of the healthcare service itself are in our Master Service Agreement, which you'll sign before any visit. Together, these two documents cover the website you're reading and the service you may book.

Section 01

About these terms.

These Terms of Service ("Terms") are an agreement between you and Whistler Acuity Health Consulting ("Whistler Acuity", "we", "us") governing your use of the whistleracuity.com website and any associated pages we operate (the "Website").

By using the Website, you agree to be bound by these Terms. If you do not agree, please don't use the Website.

These Terms cover the Website only. Terms covering the healthcare service itself — including scope of service, your acknowledgements, assumption of risk, limitation of liability, and privacy — are set out in our Master Service Agreement, which you'll be asked to sign before any visit.

Section 02

The service we provide.

The Website describes Whistler Acuity's private health assessment service, which is a paid in-person service provided at your accommodation in Whistler, British Columbia. Detailed terms of the service — including scope, what we do and do not do, and important medical disclaimers — are in our Master Service Agreement.

Whistler Acuity is a private health consulting service — not a licensed paramedic service, ambulance service, or registered medical practice. For any life-threatening emergency, call 911 immediately. Nothing on the Website is a substitute for emergency care.

Section 03

Acceptable use of the Website.

You agree to use the Website only for lawful purposes and in ways that do not infringe the rights of, restrict, or inhibit anyone else's use of the Website. Specifically, you agree not to:

  • Use the Website in any way that violates applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the Website, our systems, or accounts that aren't yours
  • Scrape, copy, or systematically harvest content from the Website without our written permission
  • Introduce malware, viruses, or any code intended to damage, disable, or compromise the Website
  • Impersonate another person, or misrepresent your identity or affiliation
  • Submit false, misleading, or fraudulent information through any form on the Website
  • Use the Website for any commercial purpose (such as advertising or solicitation) without our written consent

Intellectual property & Website content.

All content on the Website — including text, graphics, logos, the "Whistler Acuity" name and wordmark, the heartline mark, photography, layout, design, and code — is owned by Whistler Acuity or licensed to us, and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may view and read content on the Website for personal, non-commercial use, and share links to the Website with others. You may not reproduce, republish, distribute, modify, or use Website content for commercial purposes without our prior written permission.

The "Whistler Acuity" name, wordmark, and heartline mark are trademarks of Whistler Acuity Health Consulting.

Section 05

Information on the Website is not medical advice.

The information published on the Website is provided for general informational purposes only. It is not personalised medical advice, is not a substitute for assessment by a qualified healthcare professional, and should not be relied on to diagnose or treat any medical condition.

Do not delay seeking medical advice, disregard medical advice you have received, or attempt to self-treat based on anything you read on the Website. If you are concerned about your health, contact a qualified healthcare provider. If you believe you are experiencing a medical emergency, call 911 immediately.

Section 06

Bookings, payment & cancellation.

You may use the Website to request a visit through our booking calendar or contact forms. A booking request is not a confirmed appointment until we acknowledge it. We may decline a booking at our discretion — for example, where a request falls outside our scope of practice or available hours.

Once a visit is booked, payment, cancellation, and dispatch fee terms are set out in the Master Service Agreement. In summary: payment is due at the time of service; cancellations before dispatch are free; cancellations after we have been dispatched incur a $95 dispatch fee.

Membership terms are separately agreed at the time of purchase and are subject to the Master Service Agreement for each visit booked under the membership.

Section 07

Third-party services & links.

The Website may contain links to third-party websites or services (for example, travel insurers, partner hotels, or referenced clinics). We provide these links for convenience. We don't control these third-party sites and aren't responsible for their content, privacy practices, or availability. Visiting a third-party site through a link on our Website is at your own risk and subject to that site's own terms.

We also use third-party services to operate the Website and our business (such as our customer relationship management, payment processing, email delivery, and analytics providers). Your interactions with those services are governed by their own terms and privacy policies. Our handling of your information is described in our Privacy Policy.

Section 08

Disclaimers & limitation of liability.

8.1 Website provided "as is"

The Website is provided on an "as is" and "as available" basis. We make reasonable efforts to keep the Website accurate, secure, and available, but we don't warrant that the Website will be uninterrupted, error-free, free of viruses, or that the information is complete or current.

8.2 Limitation of liability for Website use

To the maximum extent permitted by law, Whistler Acuity Health Consulting, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Website — including, without limitation, damages for lost data, lost business, or interruption of service.

8.3 Service liability separate

Liability arising from the in-person healthcare service itself — not from your use of the Website — is governed by the Master Service Agreement, including the limits and indemnification provisions set out there.

Section 09

Privacy.

Our handling of personal and health information is described in detail in our Privacy Policy, which is incorporated by reference into these Terms. By using the Website, you confirm that you've reviewed the Privacy Policy and consent to the practices described there.

Section 10

Changes to these terms.

We may update these Terms from time to time to reflect changes in our practices, services, or legal obligations. Any material changes will be reflected by updating the "Last reviewed" date at the top of this page.

Continuing to use the Website after the Terms have been updated constitutes acceptance of the updated Terms. If you don't agree to a change, please stop using the Website.

Section 11

Governing law, disputes & how to contact us.

11.1 Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein.

11.2 Disputes

Any dispute arising from these Terms or your use of the Website will first be addressed through good-faith negotiation, then mediation if needed, before any legal action. Legal proceedings shall be brought exclusively in the courts of British Columbia.
