This is the agreement you'll be asked to sign before any visit. It covers scope of service, your acknowledgements, assumption of risk, limitation of liability, privacy, payment, transport, and governing law. You can review it at any time below, or get in touch with questions before booking.
Whistler Acuity (operating as Whistler Acuity Health Consulting) provides private health assessment, injury triage, and first aid services in Whistler, British Columbia. Your practitioner is Michael Van Rooyen, with 9 years of clinical experience as an Advanced Care Paramedic. This service operates as an independent health consulting business — not a paramedic service, ambulance service, or registered medical practice.
Emergency
Chest pain, difficulty breathing, uncontrolled bleeding, signs of stroke, or loss of consciousness — call 911. This service is not a substitute for emergency care.
By signing this agreement, you confirm that you understand and agree to each of the following:
You acknowledge that health assessment and first aid carry inherent risks, including: an incomplete or inaccurate clinical impression; adverse reactions to over-the-counter medications; pain, discomfort, or bruising from physical examination; and the possibility that your underlying condition may be more serious than initially assessed. You voluntarily assume these risks, and understand that Whistler Acuity has taken reasonable steps to minimise them through professional standards of care and clear referral pathways.
To the maximum extent permitted by law, Whistler Acuity Health Consulting, its owner(s), employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the services provided, including loss of income, travel costs, accommodation expenses, emotional distress, or damages arising from reliance on the clinical impression. The total aggregate liability of Whistler Acuity for any claim arising from a single service visit shall not exceed the fee paid by the client for that visit.
You agree to indemnify, defend, and hold harmless Whistler Acuity Health Consulting, its owner(s), employees, and contractors from any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) any inaccuracy or omission in the medical history, allergy, or medication information you provided; (b) your decision to decline or not follow practitioner recommendations, including recommendations to seek emergency care; or (c) your use of the assessment report for purposes other than personal health management or insurance documentation.
Whistler Acuity does not guarantee any particular health outcome. Services represent a professional assessment based on the information available and the practitioner's clinical judgement at the time of the visit. Conditions can change, evolve, or present differently over time. This service is one component of your healthcare — not a replacement for ongoing medical care.
Whistler Acuity collects personal and health information solely to provide the assessment service. Your information will be:
You may request access to, correction of, or deletion of your personal information at any time. Whistler Acuity complies with the British Columbia Personal Information Protection Act (PIPA).
Payment is due at the time of service. We accept credit card, debit, e-transfer, and cash. An itemised invoice and assessment report will be provided for submission to your travel insurance provider.
If you cancel after the practitioner has been dispatched to your location, a dispatch fee of $95 will apply. Cancellations made before dispatch are free.
Whistler Acuity does not bill insurers directly. You pay at the time of service and submit your invoice and report to your insurer for reimbursement.
If the practitioner recommends you attend a clinic or emergency department, and you request or accept transport in the practitioner's private vehicle, you understand that:
Your specific consent or refusal of transport will be confirmed at the time of your visit on the Visit Confirmation form.
This agreement is governed by the laws of British Columbia and the federal laws of Canada applicable therein. Disputes will first be addressed through good-faith negotiation, then mediation if needed, before any legal action. Legal proceedings shall be brought exclusively in the courts of British Columbia.
How Signing Works
Before any visit, you'll be asked to digitally sign this Master Service Agreement using a link sent by SMS or email — usually a minute or two. If you'd prefer paper, the practitioner will have a printed copy at the door and you can sign on arrival.
A copy of your signed agreement is retained securely for seven years and is available to you on request. If the client is under 19 (the age of majority in BC), a parent or legal guardian must sign on their behalf.
